How do I run a preliminary freedom-to-operate (FTO) assessment?

What are the supported jurisdictions?
In this context, a jurisdiction is a conventional or actual country or region where a specific patent has been granted or a patent application has been filed.

Evalify allows you to assess the preliminary freedom-to-operate (FTO) score by benchmarking an opportunity against patents from all jurisdictions or from IP5 only, or it enables you to specify the jurisdictions of interest based on your specific needs.

Do I need to have patents to use Evalify?
Short answer: not at all. Evalify doesn't check or look for patents in your technology, but uses patent-derived information and insights to assess your technology. From each startup pitch deck, Evalify derives the potentially patentable (and valuable) technical features and checks them one by one against existing active patents worldwide to determine if your startup idea will bring you to crowded territories where it's easy to be on an infringement trajectory path or if, instead, you're most probably building something that gives you the freedom to operate (FTO) from day one. How do I get an optimal assessment?
To maximize the assessment accuracy and precision, make sure you provide the system with the following information:

Comprehensive Problem Description
- Clarify the Problem and Context: Articulate the startup's specific problem and highlight the solution's relevance to the target users or industries. This will build the necessary context information to include, exclude, and classify results while analyzing the relevant patents.

Detailed Solution Description
- Mechanics of the Solution: Describe both ‘what’ and ‘how’ the product or service resolves the problem. Include technical specifics and the operational mechanisms. Point out innovative aspects that go beyond minor improvements. Detail what sets the solution apart in design, technology, and application.
- Technical Specifications: Provide exhaustive descriptions of the technologies, processes, or methodologies employed in the solution.

Optionally, Visuals
- Visuals, if needed: Include diagrams, flowcharts, and the like to clarify complex technologies or processes. This aids the Evalify AI systems to correlate related concepts. However, consider this as "optional."

In brief, by ensuring quality descriptions of both the 'what' and 'how' (particularly the 'how'), you increase the precision, accuracy, and reliability of the Evalify assessment.
What are the supported input files?
We support PDF files only. We strongly advise using extended pitch decks rather than the brief ones typically used for presentations. Should you wish to include further details beyond your extended pitch deck, you are welcome to incorporate extra slides or pages into your submission. Please ensure all materials are combined into a single file for upload. The maximum file size we can analyze at the moment is 40 MB.
Do you store my pitch decks?
The privacy and security of your documents are our top priority. We do not store or retain your pitch decks; the same applies to our trusted third-party service providers. When you upload your pitch decks, our system comprehends and analyzes the content. This process involves searching for relevant intellectual property, interpreting results, crafting comprehensive reports, and deriving insights for you. This way, we only retain the analysis results. This ensures that you can access and review these reports anytime via your profile without compromising the confidentiality of your original documents. If you prefer not to keep the analysis results, you have the option to delete them directly from your account. Upon deletion, we permanently remove these results from our systems and databases, making recovery impossible. Should you need again the analysis results in the future, a new upload and analysis cycle would be required. What is the difference between patentability/novelty search and FTO search?
A "patentability search," also known as a "novelty search," is an in-depth investigation conducted by patent experts to find any existing inventions or ideas that resemble the one a person intends to patent. The aim is to determine if the proposed invention is indeed new and unique enough to merit a patent. It is typically done before filing for patents.

On the other hand, a "Freedom-to-Operate (FTO) search," also called a "product/patent clearance search," is used to assess whether one can develop, manufacture, and market their product without infringing on somebody else's patents. This search ensures that there are no existing patent-related obstacles that would prevent the product from being commercialized in a particular geographic area (jurisdiction).
